By purchasing artwork from Kate Scharf, you agree to be bound by these terms and conditions. Please read them carefully before making a purchase.

Payment must be made in full before the artwork is shipped or handed over to the buyer. We accept EFT (electronic funds transfer) for transactions, as well as payments made via the website payment gateway. Prices are listed in South African Rands (ZAR) and are exclusive of any shipping fees.

a. Once payment is received, the artwork will be shipped to the address provided by the buyer.
b. Shipping costs will be calculated at the time of purchase and are the responsibility of the buyer.
c. Kate Scharf is not responsible for any delays or damages that may occur during shipping. However, we will make every effort to ensure the artwork is packaged securely.

a. All sales are final. We do not offer refunds or exchanges.
b. In the rare event that the artwork is damaged during shipping, Kate Scharf will work with the buyer to resolve the issue. The buyer must provide photographic evidence of the damage within 3 days of receiving the artwork.
c. If a refund is deemed appropriate by Kate Scharf, it will be processed using the original payment method.

a. The artist retains the copyright to all artwork sold. Purchasing the artwork does not transfer the copyright to the buyer.
b. The buyer agrees not to reproduce, distribute, or display the artwork for commercial purposes without the express written consent of Kate Scharf.

b. It is the buyer’s responsibility to ensure that the contact information is accurate and up-to-date.

The client acknowledges and agrees that artworks will only be reserved upon receipt of full payment for the purchase price. Until payment is received in full, the artist retains the exclusive right to offer the artwork for sale to other potential buyers.

Prior to the commencement of any commissioned artwork, the client agrees to submit a non-refundable deposit equal to 50% of the total quoted commission fee. The deposit serves as a commitment and is required to secure the artist’s time and resources for the project. The remaining 50% of the commission fee will be due upon completion and delivery of the commissioned artwork. Failure to submit the initial deposit may result in a delay or cancellation of the commission.

These terms and conditions are governed by the laws of South Africa. Any disputes arising from the purchase of artwork will be resolved through arbitration in accordance with the rules of the [Arbitration Organization] before resorting to litigation.

By completing a purchase, you acknowledge that you have read, understood, and agreed to these terms and conditions. Kate Scharf reserves the right to update or modify these terms at any time without prior notice.
